1. Acceptance of Terms

By accessing or using DevilCall's Voice over Internet Protocol (VoIP) services, website, APIs, or any related products (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree, you must not use our Services. These terms constitute a legally binding agreement between you ("Customer," "User," or "you") and DevilCall ("Company," "we," "us," or "our").

2. Service Description

DevilCall provides VoIP telecommunications services including but not limited to:

  • Outbound and inbound voice calling via SIP trunking
  • Direct Inward Dialing (DID) number provisioning
  • Call routing, forwarding, and IVR services
  • API access for programmatic call management
  • Auto-dialer and predictive dialing tools
  • Call recording and analytics
  • SMS and messaging services where available

3. Account Registration & Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Provide accurate, current, and complete registration information
  • Maintain the security of your account credentials
  • Be a legally registered business entity for reseller and enterprise accounts
  • Comply with all applicable Know Your Customer (KYC) verification requirements

You are solely responsible for all activity under your account. Notify us immediately of any unauthorized use or security breach.

4. Acceptable Use Policy

You agree NOT to use DevilCall Services for:

  • Illegal robocalling, spam, or unsolicited bulk communications
  • Caller ID spoofing with intent to defraud or cause harm
  • Transmitting threats, harassment, or abusive content
  • Activities violating the TCPA, GDPR, or equivalent local regulations
  • Fraudulent traffic pumping, toll fraud, or artificially inflating call volumes
  • Reselling services without an authorized reseller agreement
  • Bypassing international call termination regulations (SIM boxing, unauthorized GSM gateways)
  • Any activity that disrupts the integrity or performance of our network

Violations may result in immediate suspension, termination, and forfeiture of remaining balance without refund.

5. Billing, Payments & Refunds

  • Prepaid Model: Services operate on a prepaid credit basis. Maintain a positive balance to use services.
  • Subscription Plans: Monthly plans auto-renew unless cancelled at least 24 hours before renewal.
  • Rate Changes: We may modify calling rates with 7 days' notice via email and website.
  • Billing Disputes: Must be raised within 30 days of the charge.
  • Refunds: Unused credits refundable within 14 days minus usage and 5% processing fee. Monthly fees are non-refundable once the cycle begins.
  • Taxes: Prices exclude applicable taxes, levies, and regulatory fees.

6. Service Level Agreement (SLA)

  • Uptime: 99.95% target, measured monthly excluding scheduled maintenance.
  • Credits: Service credits available if uptime falls below 99.95%.
  • Maintenance: Scheduled during off-peak hours with 48 hours' notice.
  • Exclusions: Force majeure, third-party failures, customer equipment, DDoS attacks.

7. Emergency Services (E911) Disclaimer

DevilCall VoIP services are NOT a replacement for traditional telephone services. Our Services do not support 911 or emergency calling unless explicitly stated. You must maintain alternative means to access emergency services. DevilCall is not liable for damages arising from inability to reach emergency services.

8. Number Porting & DID Numbers

  • Number porting subject to carrier approval (7–21 business days)
  • DID numbers are leased, not owned; may be reclaimed upon account termination
  • Number availability not guaranteed in all regions
  • Porting fees and monthly DID charges apply per rate schedule

9. Call Recording & Data Privacy

  • You are responsible for complying with consent/notification laws when using call recording
  • CDRs retained for 12 months unless otherwise required by law
  • Personal data processed per our Privacy Policy and GDPR/CCPA
  • We do not sell customer data to third parties

10. Intellectual Property

All trademarks, logos, software, APIs, and content are our exclusive property. Reproduction or derivative works require prior written consent. API use governed by separate API Terms.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVILCALL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Total liability shall not exceed amounts paid in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless DevilCall from claims, damages, or expenses arising from your use of Services, violation of Terms, or infringement of third-party rights.

13. Termination

  • Either party may terminate with 30 days' written notice
  • Immediate suspension/termination for Terms violations
  • Remaining balance (minus charges) refundable per refund policy
  • Surviving provisions remain in effect

14. Governing Law & Dispute Resolution

Governed by laws of the State of Delaware, USA. Disputes resolved through binding arbitration (AAA rules). Class action waiver applies.

15. Modifications

We may update these Terms with 14 days' notice. Continued use constitutes acceptance.
